Notice of Public Hearing Concerning Application for Minor Variance and Consent

Owner: Freeman Location: 158 and 162 Aqueduct Street PURPOSE: Application is made for consent to partial discharge of mortgage or charge and to convey approximately 70.74 square metres of land containing a single dwelling and a shed (to be removed), shown as Part 1 on the sketch attached to the application, for continued residential use of the dwelling known as 162 Aqueduct Street. Part 2, being approximately 112.87 square metres of land, will be retained for continued residential use of the single dwelling known as 158 Aqueduct Street. The effect of this consent application is to create 1 new lot for an existing single dwelling. The subject land is also subject to concurrent Minor Variance File Nos. PLMV202500008 and PLMV202500006.

Owner: Freeman Location: 158 Aqueduct Street PURPOSE: Variance requested from Zoning By-law 2017-117, as amended as follows: Section 7.3.1 - RL2 Zone - Single-Detached - Column 7 - To permit a minimum rear yard of 5 metres instead of the required 6 metres for an existing dwelling on a proposed lot (Part 1 on sketch). The subject land is also subject to concurrent Consent Application File No. PLCON202500005. EXPLANATORY NOTE: Relief is requested to permit the creation of a new lot with a reduced rear yard for the existing dwelling on Part 1 of the sketch. An existing wood shed and portions of the front and rear wood decks/steps will be removed, all as shown on the sketch.

Owner: Freeman Location: 162 Aqueduct Street PURPOSE: Variances requested from Zoning By-law 2017-117, as amended as follows: Section 6.9.1 b) - To permit a maximum driveway width of 9.42 metres near the front lot line and 26.09 metres near the existing dwelling and attached garage, instead of the maximum driveway width of 6 metres. Section 7.3.1 - RL2 Zone - Single-Detached - Column 7 - To permit a minimum rear yard of 0.93 metres instead of the required 6 metres for an existing dwelling on a proposed retained lot (Part 2 on sketch). The subject land is also subject to concurrent Consent Application File No. PLCON202500005. EXPLANATORY NOTE: Relief is requested to permit the creation of a retained lot with an increased driveway width and a reduced rear yard for the existing dwelling on Part 2 of the sketch. An existing vinyl shed will be relocated off the north lot line to the south side yard and portions of the existing driveway will be removed and landscaped, all as shown on the sketch.

Owner: Becker and Bennett Location: 485 Biggar Road PURPOSE: Application is made for consent to lease approximately 255 square metres of land containing an existing telecommunications tower, shown as Part 1 on the draft reference plan attached to the application, for continued use of the telecommunications tower. Part 2, being approximately 27,986.5 square metres of land will be retained for continued rural residential use of the existing dwelling and shed known as 485 Biggar Road. The effect of this consent application is to extend an existing lease over Part 1 for continued use of the telecommunications tower.

A Public Hearing will be held by the Committee to consider these Applications at 5:00 P.M., Thursday, November 13, 2025 at the Civic Square, Council Chambers, 60 East Main Street, Welland.
You are entitled to attend this Hearing in person to express your views orally in favour of, or in opposition to, the Applications.
You may make written comments in favour of, or in opposition to, the Applications, to be considered by the Committee at the Hearing. Please submit written comments to the Secretary-Treasurer at the address or email shown below by Thursday, November 6, 2025. All comments received will form part of the public record.
If you do not participate in this Hearing, it may proceed in your absence and except as otherwise provided in the Planning Act, you will not be entitled to any further notice in the proceedings.
The Applicant or their Agent must participate in the Hearing.
If a specified person or public body that files an appeal of a Decision of the City of Welland Committee of Adjustment in respect of the proposed Consents does not make written submissions to the City of Welland Committee of Adjustment before it gives or refuses to give a provisional Consent, the Ontario Land Tribunal may dismiss the appeal.
If you wish to be notified of the Decision of the City of Welland Committee of Adjustment in respect of the proposed Consents and Variances, you must make a written request to the Secretary-Treasurer at the address or email shown below. This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing should the Decision be appealed by the Applicant, the Minister or a specified person or public body that has an interest in the matter.
