Owner: Bosco Property Holdings Location: 299 First Avenue PURPOSE: Application is made for consent to convey approximately 637.34 square metres of vacant land, shown as Part 1 on the sketch attached to the application, for future residential use of a dwelling. Part 2, being approximately 951.69 square metres of land, will be retained for continued residential use of the existing dwelling known as 299 First Avenue. The effect of this consent application is to create 1 new lot for a future dwelling.

Owner: Nazarian Location: 17 Riverside Drive PURPOSE: Variances requested from City of Welland Zoning By-law 2017, as amended, as follows: Section 6.1.3 d) - To permit parking spaces to be located 0 metres from the street line instead of the minimum 3 metres from the street line and to exempt the required 3 metre wide planting strip between the street line and the parking spaces. Section 6.4.1 - To permit a reduction in the number of required parking spaces from 9 to 7 for a proposed 10 unit multiple dwelling. Section 6.7.2 f) - To permit bicycle parking to be accessed by an aisle with a minimum width of 1.3 metres instead of the minimum width of 1.5 metres. Section 6.9.3 a) - To permit the required parking for the proposed multiple dwelling to be located 0 metres from the street line whereas parking shall not be located within 3 metres of the street line. Table 8.3.1 - CC2 Zone - Column 7 - To permit a minimum rear yard of 1.9 metres instead of the required 3 metres. EXPLANATORY NOTE: Relief is requested to permit a new 10 unit multiple dwelling with a reduced rear yard, reduced parking spaces, reduced bicycle aisle width, parking located at the street line, and no planting strip between the parking and the street line. The existing dwelling, garage and shed will be demolished.

Location: 130 Niagara Street PURPOSE: Variances requested from City of Welland Zoning By-law 2017, as amended, as follows: Schedule B: Special Exceptions 43. RH-43 1. - The request is to vary the uses permitted from "That the uses permitted in the RH-43 Zone shall be those in the RH Zone and a ten (10) storey, 105 unit tiered apartment building." to "That the uses permitted in the RH-43 Zone shall be those in the RH Zone and a nine (9) or ten (10) storey tiered apartment building which shall contain maximum 105 units". Schedule B: Special Exceptions 43. RH-43 2. - The request is to vary the provisions from "That the provisions of the RH-43 Zone shall be those provided for in the RH Zone save and except as follows for a ten (10) storey, 105 unit tiered apartment building: West Yard Minimum 6.0 metres, East Yard Minimum 20.0 metres, North Yard Minimum 16.0 metres, South Yard Minimum 13.0 metres, Lot Density Maximum 141 units per net hectare" to "That the provisions of the RH-43 Zone shall be those provided for in the RH Zone save and except as follows for a nine (9) or ten (10) storey tiered apartment building with a maximum of 105 units: West Yard Minimum 6.0 metres, East Yard Minimum 20.0 metres, North Yard Minimum 16.0 metres, South Yard Minimum 13.0 metres, Lot Density Maximum 141 units per net hectare". Schedule B: Special Exceptions 43. RH-43 4. - The request is to vary the parking requirements from "Notwithstanding the parking requirements of Section 6.40 of Zoning By-law, as amended, on-site parking shall be provided at 1.25 spaces per unit" to "Parking shall be provided at 1 space per unit, except where a dwelling unit is 50.0 m2 in gross floor area or less, in which case, parking shall be provided at a rate of 0.3 spaces for each such unit and no visitor parking is required". EXPLANATORY NOTE: Relief is requested to vary the site specific RH-43 Zone uses and provisions to permit flexibility in the number of storeys and number of units for a proposed tiered apartment building (maximum 10 storeys and maximum 105 units), and to permit a reduced parking spaces calculation to be provided at 1 space per dwelling unit except for units 50 m2 or less in gross area to be provided at 0.3 spaces per unit.

A Public Hearing will be held by the Committee to consider these Applications at 5:00 P.M., Wednesday, March 4, 2026 at the Civic Square, Council Chambers, 60 East Main Street, Welland.
You are entitled to attend this Hearing in person to express your views orally in favour of, or in opposition to, the Applications.
You may make written comments in favour of, or in opposition to, the Applications, to be considered by the Committee at the Hearing. Please submit written comments to the Secretary-Treasurer at the address or email shown below by Thursday, February 26, 2026. All comments received will form part of the public record.
If you do not participate in this Hearing, it may proceed in your absence and except as otherwise provided in the Planning Act, you will not be entitled to any further notice in the proceedings.
The Applicant or their Agent must participate in the Hearing.
If a specified person or public body that files an appeal of a Decision of the City of Welland Committee of Adjustment in respect of the proposed Consents does not make written submissions to the City of Welland Committee of Adjustment before it gives or refuses to give a provisional Consent, the Ontario Land Tribunal may dismiss the appeal.
If you wish to be notified of the Decision of the City of Welland Committee of Adjustment in respect of the proposed Consents and Variances, you must make a written request to the Secretary-Treasurer at the address or email shown below. This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing should the Decision be appealed by the Applicant, the Minister or a specified person or public body that has an interest in the matter.
