Notice of Public Hearing to Consider Change of Conditions of Consent

Owner: King and Benton Regeneration Lands Inc.
Location: 65 Canal Bank Street
NATURE OF REQUEST: The Owner, via its Agent, has requested a Change of Conditions to the Notice of Decision dated July 16, 2024 wherein the Committee of Adjustment Granted the Consent with 13 Conditions of Approval. The request is the removal of Condition 4 - "Provide clearance from the MECP that all legislative requirements have been satisfied", due to the broad nature of the Condition. The Change of Conditions, if approved, will amend the two year provisional approval period from the date of giving Notice of the Change of Conditions.

2. FILE NO. B016-2024WELL

Owner: 200 Dain Welland Development Ltd.
Location: 160 and 200 Dain Avenue
NATURE OF REQUEST: The Owner, via its Agent, has requested a Change of Conditions to the Notice of Decision dated July 16, 2024 wherein the Committee of Adjustment Granted the Consent with 10 Conditions of Approval. The request is the removal of Condition 2 - "Provide clearance from the MECP that all legislative requirements have been satisfied", due to the broad nature of the Condition. The Change of Conditions, if approved, will amend the two year provisional approval period from the date of giving Notice of the Change of Conditions.

A Public Hearing will be held by the Committee to consider the requests at 5:00 P.M., Wednesday, May 27, 2026 at the Civic Square, Council Chambers, 60 East Main Street, Welland.

You are entitled to attend this Hearing in person to express your views on the requests for a change of conditions.

You may make written comments on the requests to be considered by the Committee at the Hearing. Please submit written comments to the Secretary-Treasurer at the address or email shown below by Thursday, May 21, 2026. All comments received will form part of the public record.

The Applicant or their Agent must participate in the Hearing.

If you wish to be notified of the Decision of the City of Welland Committee of Adjustment in respect of the proposed Variance Applications, you must make a written request to the Secretary-Treasurer at the address or email shown below. This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing should the Decision be appealed by the Applicant, the Minister or a specified person or public body that has an interest in the matter.

Additional information regarding the Requests for Change of Conditions will be available to the public for inspection in Planning and Development Services - Planning Division weekdays between 8:30 a.m. and 4:30 p.m.
